So the DOJ looked at this and said there is nothing to pursue and no way to legitimately prove intent. And now they are using broken New York State laws to go after him because there they don't have the obligation to prove intent properly.

What will be really telling is if the judge violates his first, 4th, and 5th amendment rights by issuing a gag order so that his ability to defend himself under due process is crippled..

Which is right out of the Alex Jones trials.

The circumvention you see tested today will be used against you tomorrow.

Goodbye Haebus Corpus, and welcome Corpus Juris.

Well, no.

If the DOJ looked at these charges and did not prosecute it was either because it is outside their jurisdiction or there was a conspiracy pro trump involved.

And no.

Gag orders are issued to avoid the trial be "held in public" and thus influencing the jury. It is exactly to MAINTAIN due process. The defendant, if they wish to do so, may present their position in court (just like jones did).

and again no.

this is not a circumvention at all.

Nothing is outside the jurisdiction of the DOJ. They have federal reach. You can't cry blue anon conspiracy one way and then claim their no conspiracy another way. If the logic can't be applied universally, it's not logic it's propaganda.

That's not how gag orders have been used for Alex Jones at all. They judge literally gave him a list f things he was not permitted to say IN COURT that had to do with his defense otherwise he would be held in contempt. That had nothing to do with protecting due process, in fact quite the opposite. The way they ran his trial was unprecedented and they are using that model as blue print for all anti establishment voices.

He spoke outside of court on his show all during the trial any way he wanted.

So yes, this is circumvention. And this clown show trial may amount to election interference. Basically they are saying the people are not permitted to vote for Trump in 2024.

They don't have that authority, and if Trump is charged on this unprovable nonsense because NY doesn't have to prove intent like everywhere else. Then we should be able to imprison Biden for Accepting China money which is on Hunter's laptop, We should be able to Imprison Obama for war crimes in Syria and Lybia, Bush for War crimes in Iraq, and Clinton for Perjury.

But of course, the logic is not universally applied here.

Old man is tired, why don't you call some of your former "employees" and tell them they failed or something.

Can a ham sandwich get indicted?
Since, traditionally, the defense doesn't get a say, it's pretty easy to get a grand jury to indict someone in most cases. In fact, it's so easy in most cases that a former New York state chief judge, Sol Wachtler, famously remarked that a prosecutor could persuade a grand jury to “indict a ham sandwich.”
